These Terms & Conditions govern your use of services provided by Digital Craft, a UK-based sole trader business offering website creation, automation systems, and business support tools.
By purchasing or using our services, you agree to be bound by these terms.
1. Services Provided
Digital Craft provides:
Custom website design and development
Automation system setup (including CRM, calendars, email/SMS workflows, and dashboards)
Ongoing platform access and support (as part of a subscription)
We may add, remove, or improve features over time to maintain quality and performance.
2. Account Access & Use
To access our systems, you will be issued a client login. You are responsible for maintaining the confidentiality of your login details and for all activity carried out under your account.
You agree to use our services only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the services.
3. Client Responsibilities
Clients using our platform to manage their own customers are responsible for:
Ensuring all content entered into the system is lawful, accurate, and GDPR-compliant
Obtaining appropriate consent to store, process, and communicate with their contacts
Using the system in accordance with UK data protection laws
Digital Craft is not liable for how clients use the platform to manage, store, or process their own customer data.4. Payments & Cancellations
All payments are processed securely through Stripe.Your subscription can be cancelled at any time. Cancellation will result in the suspension of access at the end of your current billing period unless otherwise agreed.Setup fees (if applicable) are non-refundable once work has commenced.
4. Payments, Minimum Term & Cancellations
All payments are processed securely through Stripe.
Minimum Term
By signing up for any subscription-based system or platform, you agree to a minimum commitment period of twelve (12) months starting from the date your subscription begins.
This minimum term applies regardless of usage, activity level, or business performance.
Cancellations
Subscriptions may not be cancelled within the initial 12-month minimum term.
After the minimum term has ended, you may cancel your subscription at any time.
Cancellation after the minimum term will result in suspension of access at the end of your current billing period unless otherwise agreed in writing.
Setup Fees
Any setup, onboarding, or implementation fees are non-refundable once work has commenced, regardless of cancellation or termination.
4a. Website Ownership, Buyout & Transfer on Cancellation
If a client cancels their subscription or their service is terminated for any reason, ownership of the website does not automatically transfer to the client.
Website Buyout Option
Clients may request to retain ownership of their website by purchasing it outright.
The buyout price will be quoted at the time of cancellation and will be based on:
The size and complexity of the project
The scope of design and development work completed
Any custom functionality or integrations
This one-time fee covers:
Administrative time required to prepare the website for transfer
Transfer of the website and associated files to a new hosting provider
Transfer of the domain where applicable
Transfer & Ongoing Costs
Once the website has been transferred:
The client becomes the sole owner and controller of the website
All hosting, domain, email, and third-party service costs become the responsibility of the client
Digital Craft will have no further responsibility for maintenance, updates, security, or availability unless a separate agreement is entered into
No website, files, or assets will be transferred until the quoted buyout fee has been paid in full.
5. Intellectual Property
Unless otherwise agreed in writing:
All design work, websites, systems, and custom content provided by Digital Craft remain the intellectual property of Digital Craft until full payment has been received.
Platforms, systems, and software access are licensed for use during an active subscription only and may not be copied, resold, sublicensed, or redistributed.
6. Service Availability
We aim to provide reliable and uninterrupted access to our systems and websites; however, we do not guarantee that services will always be available, uninterrupted, or error-free.
Planned maintenance, updates, or technical issues may cause temporary disruption. Where possible, we will take reasonable steps to notify clients of major downtime or updates.
7. Limitation of Liability
Digital Craft is not liable for:
Any indirect, incidental, or consequential loss arising from use of our services
Loss of business, revenue, profits, data, or opportunities
Issues caused by third-party services, software providers, hosting platforms, or client misuse
Delays or failures caused by events beyond our reasonable control
Our total liability in any circumstance shall not exceed the total amount paid by you for services in the 30 days preceding the claim.
8. Termination of Service
We reserve the right to suspend or terminate access to services if a client:
Violates these Terms
Uses the system for unlawful, abusive, or harmful purposes
Fails to make required payments
In such cases, no refunds will be issued, and outstanding balances for the remainder of the minimum term may still be payable.
9. Changes to Terms
We may update these Terms from time to time. Updated versions will be posted on our website. Continued use of our services after changes are made constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of the United Kingdom.
